  Comment: Rice (1998:85) used Ziphiidae Gray "1850" [1865!] over Hyperoodontidae Gray 1846 "in anticipation of" an ICZN petition & ruling. As of late 2008 the required application has not been submitted (see ICZN 1999 [4th] Edition Art. 23.9.1, 23.9.3, 23.12, 1985 [3rd] & 1961 [1st] Edition Art. 23b). Hyperoodontiidae is also used in works Rice didn't note (e.g., McKenna & Bell 1997). Mead (email 28-Oct-2008) advises to follow McKenna & Bell on this  
    Appeals to ICZN Art. 23.12 for use of the junior Ziphiidae over the senior Hyperoodontidae do not appear to fulfill the strict requirements of that Article and its sub-clauses (see ICZN 1999 [4th] Edition Art. 23.9.1, 23.9.3, 23.12, 1985 [3rd] & 1961 [1st] Edition Art. 23b)  
    As of 2023, there has as yet not been an ICZN petition and ruling to conserve Ziphiidae Gray "1850" [1865!] over Hyperoodontidae Gray, 1846; so while the Society for Marine Mammalogy Committee on Taxonomy (2018) and Würsig, Thewissen and Kovacs (2018) use Ziphiidae, ITIS continues to use Hyperoodontidae
